(CNN) — The defense and prosecution were hammering out a plea deal Tuesday in the court-martial of Brig. Gen. Jeffrey Sinclair, but no matter what the negotiations hold, the defense says three things are off the table.
First, Sinclair won’t plead guilty to sexual assault, said Josh Zeitz, a spokesman for the general’s defense team. Nor will he plead guilty to any charge that will land him on a sex-offender registry. And lastly, Zeitz said, Sinclair will not plead guilty to threatening his accuser or her family. Full Article

And clearly the good General is not in favor of protecting children…
If this guy is guilty he needs to be nailed to a cross like the rest of us; web site, yearly registration, subject to plethora of lame laws, the whole nine yards. Double standards are BS!!!!
Someone as influential as a General, willing to risk harsh punishment in lieu of registration, might sway some judges and legislators in the way they perceive the process.
Hence the point of equal protection and far outta bounds of ex post facto as we are on a registry today he can clearly see is lifetime punishment ….we all would in similarly situated of plea bargain would negotiate so as to be off registry……….they need to have everyone listed today to be off registry and start over upon new crime …..this case clearly sees punishment …its against the foundation of law.

Now some interesting facts… a military judge almost nevers orders registration on anyone, that is up to the states when they get their hands on the record of trial and process those crimes in comparison to what they have..
Also there is no certificate of rehabilitation.. only one that can forgive is the president… which is never..
Also you are guilty until proven innocent under the UCMJ. For them to get to the point of a trial, there is already overwhelming evidence stacked against the General… If there was little to no solid evidence the chain of command would of shut this down and sweep it under the rug…
There will be no sway in legislation on the General’s reaction to a registration.. because the Government always sees military courtmartials has the perfect system.. 98% conviction rate..
BOTTOME LINE:
If the request to keep from being registered is accepted by the judge, CA RSOL should be ALL OVER THIS in all future court proceedings involving any sex offender issue as PROOF that the registry schema is punitive, not regulatory, and in fact could probably be challenged on that facet alone.
I should like to point out that anyone of lower rank convicted of a sex offense would lose his pension. Part of the general’s plea bargain was a “reduced pension.” And now he is refusing to plead if he must register. It must be nice to have the power to negotiate your own punishment.
Oh Boy,,,Um This is gonna be interesting how it turns out. I knew eventually this would happen a box within a box,,,? It’s starting to unravel & unsettle allot of people…& Brubaker said it… If Your accused You Will be Convicted one way or another in Cali. Now You can do it the Hard way or the really hard way! But to ask for no registry req’s & Get it? Yea That is a blatant outrage & HA,HA! in the face of the voters that voted for these laws. not to mention All those suffering due to them.
